This Privacy Policy describes how your personal information is collected, used, and shared when you visit or make a purchase from lidalida.at.

This Privacy Policy establishes our obligations to not disclose and ensure the privacy protection of personal data that the user provides when registering on the website of the online store or when placing an order for the purchase of goods.

  1. Collection and use of personal data

You can visit our site without providing any personal information. We only store access data without personal reference, such as the name of your internet service provider, date and time of the request, name of the requested file, page from which the file was requested, access status (file transferred, file not found, etc.), web browser and operating system used, complete IP address of the requesting user, data volume transferred. This data is evaluated exclusively to improve our offer and for reasons of technical security, in particular to defend against attempted attacks on our web server, and does not allow any conclusions to be drawn about your person. The legal basis for the storage is Article 6 lit. f) DSGVO.

Personal data (such as name, company, address, telephone number and e-mail address) are only collected if you provide them voluntarily as part of your contact request. We use the data you provide without your separate consent exclusively to fulfil and process your enquiry. Once your enquiry has been processed in full, your data will be blocked for further use and deleted (if necessary, after expiry of the retention periods under tax and commercial law, currently ten years), unless you have expressly consented to the further use of your data in accordance with Art. 6 lit. a and b DSGVO.

  1.  Online shop

If you visit our online shop, we store the following information in order to fulfil the contract concluded between you and LidaLida or to carry out pre-contractual measures in accordance with Article 6 lit. b) DSGVO:

  • When an order is placed in the online shop, all data necessary for the execution and processing of the order are requested by means of mandatory fields: Your title, your full name, your address (billing address and, if applicable, different delivery address), your e-mail address and your telephone number. Your data will only be used to process your order.

  • You can create a customer account. To do this, you can choose a password together with your e-mail address, both of which will enable you to log in more easily without having to enter your data again when you make a purchase at a later date. LidaLida stores the data you enter to create a customer account, which is used to enter, execute and process your orders. LidaLida will retain your data for future orders as long as you maintain your registration. You have the right to access, correct and/or delete your registration data at any time.

  • If you have registered for an account with LidaLida in the context of the online shop, LidaLida will delete your registration if you notify us of this via customerservice@lidalida.at.

  • If you submit data to LidaLida for an order, your data will be stored for as long as necessary for the processing of the purchase and as required by the statutory retention periods. The data will be stored for the purpose of providing evidence and proof in compliance with the statute of limitations or as long as liability is legally possible.

  1. Customer Portal

If you register on the LidaLida customer portal, you will receive a clear overview of the history of your orders and any enquiries. The following data will be stored in accordance with Article 6 lit. b) DSGVO: first and last name, e-mail address, password and login information.

If you wish to delete your customer portal, please send an e-mail to customerservice@lidalida.at.

  1.  Data Security

The data provided to us will only be processed for clearly defined purposes or purposes covered by your consent. The collection of data is carried out within the framework of provisions that are intended to support the initiation of a contract or to process a contract that has already been concluded and that are in accordance with the DSGVO. This does not include use for statistical purposes, provided that the data provided has been anonymised.

In accordance with the state of the art, we have taken organisational and technical measures to ensure the protection of your personal data (protection against misuse both from inside and outside, for example through firewalls, encryption, access authorisations, etc.).

However, we would like to point out that data transmissions on the Internet (e.g. when communicating by e-mail) can have security gaps. Complete protection of data against access by third parties is not possible. We accept no liability for unauthorised access by third parties, provided that this misuse was not culpably caused by us.

  1.  Credit Card Information

Any credit card information you provide will not be stored by LidaLida, but will be encrypted and collected directly from the payment service provider via hypertext transfer protocol secure ("https").

  1.  Duration of the storage

We do not keep your personal data longer than is necessary for the purposes for which they are processed. The data is also stored for evidence purposes, taking into account the limitation periods or as long as a claim (liability) is possible from us.

  1.  Sharing of personal data

As a matter of principle, we do not make your personal data available to third parties. However, in order to fulfil your order or for legal reasons, it may be necessary to pass on your data to trusted third parties. These include hosting and server co-location services, communications and content delivery networks (CDNs), data and cybersecurity services, billing and payment processing services, domain name registration managers, fraud detection and prevention service providers, web analysts, email distribution and monitoring services, session recording, remote access and performance measurement services, data optimization and branding services, content providers, and our legal and financial advisors (collectively, "Third Party Providers"): "Third Party Providers").In this case, your data will be passed on exclusively on the basis of the DSGVO (on the basis of the consent you have given, for the purpose of fulfilling a contract or fulfilling a legal obligation, etc.).

We may share personal information from the following categories with third party service providers for a business purpose:

  • Identifiers, such as name, pseudonym, mailing address, unique personal identifier, online identifier, internet protocol address, email address, account name or other similar identifiers.

  • Promotional personal data, such as personal data relating to products or services purchased, received or being considered.

We are responsible for personal data we receive and collect from customers and subsequently share with third parties. In particular, LidaLida remains responsible and liable under the Privacy Policy if third parties process personal data on its behalf in a manner inconsistent with the Principles, unless LidaLida proves that it is not responsible for the event giving rise to the damage.

Our website uses cookies. These are small text files that are stored on your end device with the help of the browser. We use cookies to make our offer user-friendly. They do not cause any harm. It is possible that some cookies remain stored on your terminal device until you delete them. They enable us to recognize your browser on your next visit. If you do not wish this, you can set up your browser so that it informs you about the setting of cookies and you allow them in individual cases. Should cookies be deactivated, the functionality of our website may be limited.

You have the right at any time to obtain information about the data stored about you, its origin and recipients as well as the purpose of the data processing. Please contact customerservice@lidalida.at for this purpose

  • Objection (market research)

You may object to the future processing of data relating to you in accordance with Art. 21 DSGVO at any time. The objection can be made in particular against processing for direct marketing purposes. To do so, please send a short e-mail to customerservice@lidalida.at, (it does not have to contain a statement of reasons) 

  • Revocation of consent (e.g. newsletter dispatch)

You can revoke your consent to the use of your personal data by LidaLida, e.g. for sending a newsletter, at any time. If you wish to revoke your consent to receive the newsletter, please click on the "Unsubscribe Newsletter" link at the very bottom of one of the newsletter e-mails you receive. In all other cases, please contact customerservice@lidalida.at.

  • Your other rights

You have the right to correct or erase or to restrict the processing of your personal data, the right to object to processing for the future and the right to data portability.

Without prejudice to any other administrative or judicial remedy, you as a data subject, have the right to lodge a complaint with a supervisory authority, in particular in the EU-Member State of your residence, place of work or the place of the alleged infringement, if you consider that the processing of personal data relating to you infringes data protection law.
